CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

  1. When you place an order via the website you are using, you are deemed to have accepted the pre-information form and the distance sales agreement provided to you electronically.

  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other applicable laws in force regarding the sale and delivery of the purchased product.

  3. Shipping costs for the product shipment will be paid by the buyers.

  4. Each purchased product is delivered to the person and/or institution at the address specified by the buyer within the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications specified in the order, along with any warranty documents, user manuals, etc., if available.

  6. In case the sale of the purchased product becomes impossible, the seller must inform the buyer in writing within 3 days of learning about this situation. The total amount must be refunded to the buyer within 14 days.

NON-PAYMENT OF THE PURCHASED PRODUCT:

  1. If the buyer does not pay the purchased product price or cancels it in the bank records, the seller's obligation to deliver the product ends.

UNAUTHORIZED USE OF CREDIT CARD IN PURCHASES:

  1. After the product is delivered, if it is determined that the credit card used by the buyer for payment has been unlawfully used by unauthorized persons, and if the sold product price is not paid to the seller by the bank or financial institution, the buyer must return the product to the seller within 3 days at the expense of the seller.

UNFORESEEN DELIVERY OF THE PRODUCT DUE TO UNFORESEEN REASONS:

  1. If unforeseen circumstances occur that the seller cannot foresee and the product cannot be delivered within the specified time, the situation is notified to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if payment was made in cash, the amount will be refunded to them in cash within 14 days from the cancellation. If payment was made by credit card and canceled, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. Before accepting delivery of the purchased product, the buyer must inspect it; damaged or defective products such as dented, broken, torn packaging, etc., will not be accepted from the shipping company. The received product will be deemed undamaged and intact. The BUYER must take care of the product after delivery. If the right of withdrawal will be used, the product must not be used. The Invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER; Within 14 (fourteen) days from the date of delivery of the purchased product to themselves or the person/institution at the address indicated by them, the buyer may exercise their right of withdrawal from the contract by notifying the SELLER via the following contact information, without assuming any legal or criminal liability and without giving any reason.

PERIOD OF RIGHT OF WITHDRAWAL:

  1. If the buyer purchases a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be used for service contracts where the service has been started with the approval of the consumer before the end of the withdrawal period.

USE OF WITHDRAWAL RIGHT:

  1. In order to use the right of withdrawal within the 14 (fourteen) day period, a written notification must be sent to the SELLER via registered mail, fax, or email, and the product must not be used within the framework of the "Products for which the Right of Withdrawal Cannot be Used" provisions specified in this contract.

RETURN CONDITIONS:

  1. The SELLER is obliged to refund the total amount and the documents that put the BUYER in debt within the latest 10 days from the date the withdrawal notice reaches them, and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods due to a reason caused by the BUYER or if it becomes impossible to return the goods, the BUYER is liable to compensate for the damages of the SELLER in proportion to the defect. However, the BUYER is not responsible for changes and deteriorations caused by the proper use of the product or service within the withdrawal period.

  3. If the use of the right of withdrawal results in the amount falling below the campaign limit set by the SELLER, the discount amount used within the scope of the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products prepared according to the buyer's request or explicitly for their personal needs, and which are not suitable for return, underwear items, swimsuits and bikini bottoms, cosmetics, single-use items, perishable or expired products, products that are not suitable for return for health and hygiene reasons once delivered, products mixed with other products after delivery and cannot be separated due to their nature, except for those provided within the scope of a subscription agreement, such as newspapers and magazines, electronic services provided instantly or non-tangible goods delivered to the consumer instantly, and audio or video recordings, books, digital content, software programs, data storage devices, computer consumables, cannot be returned if their packaging has been opened by the BUYER. Additionally, the right of withdrawal cannot be used for services performed with the consumer's approval before the end of the withdrawal period.

  2. Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, tapes, and stationery consumables (toner, cartridge, ribbon, etc.) can only be returned if their packaging is unopened, unused, undamaged, and untested.

DEFAULT AND LEGAL CONSEQUENCES:

  1. In case the BUYER defaults on payment by making payments with a credit card, the BUYER agrees, declares, and undertakes that they will pay interest to the bank within the framework of the credit card agreement between the cardholder bank and themselves, and will be liable to the bank; they also accept that they will compensate for the damages and losses incurred by the SELLER due to the BUYER's defaulting on the debt under any circumstances.
